The following terms and conditions apply to all transactions on the www.dataroam.co.uk website which is owned and operated by 0044 Ltd. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. For your ease of reference summary points to note are listed below, but please ensure you review the full content of our terms and conditions;

    • Device unlocking is the customer’s responsibility.
    • Data consumption is the responsibility of the customer, on all pre-paid and post-paid services, and all data consumption will be billed in the appropriate manner.
    • We reserve the right at all times to charge for excessive data usage and or to restrict the bandwidth of any data connection in the event that in our sole opinion the usage is high. Furthermore we may also disconnect a user either temporarily or permanently for excessive use, and in addition may charge the customer for any such excessive usage. Post-paid 30 day plan data SIMs must be returned after the inital period of rental to terminate the contract otherwise pro-rata billing applies. Data consumption on SIM cards used in devices other than those indicated suitable will be charged additionally at the prevailing network rate.
    • 0044 Ltd cannot guarantee network coverage in any geographic region.
    • 0044 Ltd provide a 6 month customer support service on pre-paid network SIMs and thereafter queries must be addressed directly to the network.
    • Refunds will not be provided if a non-faulty product has been used, activated or registered by a customer, or for poor coverage or in the event that a handset cannot be unlocked.
    • 0044 Ltd provide network SIM cards on behalf of national and specialist networks and cannot be held accountable in the event of a network ceasing to provide a product or service.
    • Non-faulty items returned in a new condition will have a £5.00 re-stocking charge levied against them.
    • Data SIM cards should only be used in suitable devices as described and incorrect usage will result in overage charges being applied. Tethering is not guaranteed and should not be relied upon - compatible mifis should be used for tethering.
    • Products delivered to an alternative address (e.g. hotel) other than the customer’s billing address are the responsibility of the customer and may require additional ID.
    • Networks tariffs & rates, promotions, free credit are dictated by the individual network and 0044 Ltd are not liable for any changes to or non-availability of such offers.
    • The prices displayed on the website are inclusive of 20% UK VAT unless otherwise specified. However, if a customer is resident in another EU country, other than the UK, they will be billed at the appropriate VAT rate of the country the that the billing address or residential address is located.

    1. Introduction

    1.1 Please read these terms and conditions carefully before using the website operated by 0044 Ltd (‘We’, ‘Us’, ‘Our’). In particular, we draw your attention to clauses 10 (Applicability of online materials) and 14 (Liability). By clicking on the ‘I Accept’ button at the bottom of these terms and conditions you agree to be legally bound by these terms and conditions as they may be modified and posted on our website from time to time.

    1.2 Without prejudice to the above, by clicking on the button marked ‘I Accept’ at the end of these terms and conditions and/or by using or accessing our website, you agree to be legally bound by these terms and conditions of use as they apply to your use of or access to our website.

    1.3 If you do not wish to be bound by these terms and conditions then you may not use our website.

    2. Nature of our website

    2.1 Our website is a place for you to select and order Mobile Phone network SIM cards ( the Products ) which make possible the use of a mobile phone service or data device internationally without the usual high costs associated with such inbound and outbound telephone calls or data consumption. Our website describes the Products in more detail.

    2.2 Please note that our website is available only to individuals that can form legally binding contracts under applicable law. Although the contents of our website are aimed at users aged 18 and above, you must be over 18 years to purchase the Products, using the payment method displayed on our website. If you do not qualify, click here to leave our website now.

    3. Buying Products on our website

    3.1 To order Products you will need to follow the ordering procedures set out here. Details of our prices for the Products, and the procedures for payment and delivery are displayed on our website.

    3.2 Any times or dates stated on our website for delivery are estimates only. We will make all reasonable efforts to deliver the Products within the time specified, but do not accept liability for any failure to deliver within that time.

    3.3 You must pay by credit or debit card at the time of order. Products will not be dispatched to you until we are in receipt of cleared funds. The price of any Product is the price in force at the date and time of your order. We may change the price of any Product before you place an order. We try to ensure that our prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure (see clause 3.4 below). We will inform you if a Product’s correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the product at the correct price. If your credit card has already been charged we will immediately issue a credit to your credit card account to the value of the incorrect price ( including delivery charges ). The prices are inclusive of applicable taxes.

    3.4 We are entitled to refuse any order placed by you or to cancel and refund an order at any time. If your order is accepted, we will confirm acceptance to you by online electronic means (‘Confirmation’) to the e-mail address you have given us on ordering. The order will then be fulfilled by the date set out in the Confirmation or, if the Confirmation does not contain such a date, within 14 days.

    3.5 You undertake that all details you provide to us for the purpose of purchasing the Products offered by us on our website will be correct, that the credit or debit card, which you use is your own, or you are authorised to use it and that there are sufficient funds or credit facilities to cover the cost of any Products. We reserve the right to obtain validation of your credit or debit card details before providing you with any Products.

    3.6 All Products and services are subject to availability and may be withdrawn at any time. If we do not supply the Products for any reason we will not charge you and we will refund any money already paid by you.

    3.7 All Products we supply are covered by the terms and conditions of the manufacturers or networks guarantee for twelve months. This guarantee excludes faults caused by accident, neglect and misuse.

    3.8 The 30 day data SIM plans are provided for specific devices as described on the website prior to purchase. Any usage in unsuitable devices will be charged at the prevailing network overage rate - please refer to the website and tariff summary for details. Clarification about device suitability can be obtained prior to purchase. 

    4. Delivery of the Products to you

    4.1 We use Royal Mail to deliver Products to you. Full details of delivery charges and times are available elsewhere on this website.

    If you would like to check the status of your order, simply email info@dataroam.co.uk 

    4.2 If for any reason the Products are returned to us, you will be responsible for paying for a recorded method of delivery to ensure safe transit of the Products.

    4.3 Delivery will usually be made to the cardholders address. This ensures that cards cannot be used at 0044.co.uk to make purchases for anyone but the card owner. It is our way of using our best endeavours to eliminate fraud.

    4.4 However we can arrange for delivery of the Products to another address if expressly requested by you such as a hotel. If we do deliver to a notified address which is not the cardholders address we will not be responsible for the safe keeping of any Products supplied to you as directed whilst such products are in the custody of the alternative delivery address you have notified to us. We will not provide any refund or any other compensation if the Products are not so held at the alternative delivery address you have notified to us.

    4.5 Overnight deliveries must be signed for and dated at the address for which they are consigned. Prior to signing you must check that the Products are received undamaged. In the highly unlikely event that Products are delivered to you damaged, it is your responsibility to ensure that you add a brief statement addressing this damage together with your signature and date on the carrier’s delivery notes. You must also inform us by contacting our delivery department at info@0044.co.uk within two days of receipt of the Products.

    4.6 Delivery prices quoted are for delivery to the UK mainland. We will deliver to Northern Ireland (BT), Isle of Man (IM), Scottish Highlands and Orkney Isles (PA,ML,EH,KA,G,KY,PH,DD) and the Outer Hebrides and the Shetland Isles (HS,ZE) but such deliveries will incur additional charges and may be subject to delay. You may email us for a quotation. AM/PM and Saturday deliveries are optional and will also incur additional charges. Full details of such charges can be obtained by emailing us.

    4.7 If the Products are temporarily out of stock we will notify you of this position and you should allow up to fourteen days for dispatch of the Products. Where delivery is delayed for more than fourteen days you will have the right to cancel the order and we will refund any money paid by you for the Products.

    4.8 If an order takes longer to arrive at the required delivery address than stipulated on the 0044 web site then the company will refund the value of the SIM card amount after 15 business days from date of order if the item has still not arrived, or when the delayed item can be returned in a new condition to the company, if it arrives later than required. If the item requires urgent replacement prior to the 15 business days lapsing then the customer must pay for another item and the company may upgrade the delivery to the overnight option at their discretion. Once the 15 business days has lapsed, or the delayed original item can be returned in a new condition then the company will refund the original purchase price of the SIM card.

    5 Returning the Products to us

    There are a number of circumstances in which the products may be returned;

    5.1 You may return any Products you have purchased together with any accessories and any supplied free gifts within seven working days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing or e-mail within those 7 working days. You will then be entitled to a refund from us, which will be paid as soon as possible, but in any event within 30 days. You must arrange for and pay the costs of both any applicable bank charges incurred by us and the costs of returning the Products to us on request. While in your possession, you must keep any Products you intend to return to us in good condition. The Products must be as new, unopened, unused and be in their original packaging and have the original manuals and accessories. If the Products are returned in a condition other than as new and unused you will not be entitled to a refund and the cost of the Products will be charged to you. If the Products are returned without manuals and accessories the cost of such items will be charged to you. Upon receipt of your cancellation notice we will issue you with a Returns Authorisation Number which will be valid for fourteen days. In circumstances where Products are returned to us which are not faulty we reserve the right to charge a five pound (£5.00 GBP) restocking charge for receiving the parcel, inspecting it and restocking it.

    5.2 If the Products are said to be ‘dead on arrival’ such that they present symptoms of software failure which prevents basic operation upon their first use you should contact our customer support helpline within seven days of the day the Products were delivered to you. You may then return the Products to us.
    Upon our receipt of the Products and confirmation of the fault by our technical engineers we will offer you either;

    5.2.1 Replacement Products which will be dispatched to you at your our cost; or
    5.2.2 A full refund provided that the Products have been verified as faulty by our technical engineers and are returned with their original packaging, manuals and accessories.

    Upon our receipt of the Products and confirmation that no fault exists by our technical engineers we will offer you either;

    5.2.3 Return of the Products and the costs of return will be charged to you; or
    5.2.4 A full refund (less any applicable delivery charges ) provided that the Products are returned as new and are complete with all original packaging, manuals and accessories. If the condition of the packaging is poor we reserve the right to charge an amount necessary to re package the Products. Missing accessories will also be charged for

    5.3 If the Products are damaged whilst in general use they must be referred to the appropriate mobile phone network for replacement or repair. We will not provide any refund for Products which are damaged in this way.

    5.4 Products returned to the incorrect address and without correct authorisation will not be accepted and will be returned directly to the sender. Please Email Us for your authorisation code and the returns address and we will deal with your enquiry promptly and efficiently.

    5.4 If you have any complaints, you should direct them to us via e-mail or by post at 0044 Ltd, 2 Chapel Court, Holly Walk, Leamington Spa, Warwickshire CV32 4YS. Returns cannot be accepted at this address and will be returned to the sender.

    6 Modifications to our website

    6.1 We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated to the contrary, any new features including new content and/or the sale of new Products shall be subject to these terms and conditions.

    6.2 Please note that although we try to ensure that the content of our website is accurate, our website may contain typographical errors or other inaccuracies.

    7 Your privacy and the Information you provide to us

    7.1 The following applies to any information you provide to us, for example during the ordering process. We are registered under the Data Protection Act 1998.

    • You authorise us to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your name and address, to the extent reasonably necessary to provide the services which are available through our website by us, our partners, successors (including the purchaser of the whole or part of our business), associates, sub-contractors or other third parties (together our ‘Partner Companies’).

    • If you obtain or choose to buy Products through our website then we may collect information about your buying behaviour and if you send us personal correspondence such as e-mails or letters then we may collect this information into a file specific to you (together, the various purposes set out in this paragraph and in our privacy policy shall be known as ‘the Purposes’). All such information collected by us shall be referred to in these terms and conditions as ‘Personal Information’.

    • You must ensure that the Personal Information you provide is accurate and complete and that all ordering or registration details (where applicable) contain your correct name, an address and other requested details.     • You acknowledge that any incorrect information which you provide to us may result in a delay to the processing of your order.

    7.2 By accepting these terms and conditions, you agree to the processing and disclosure of the Personal Information for the Purposes. If you would like to review or modify any part of your Personal Information then you should e-mail us at info@0044.co.uk

    7.3 You warrant to undertake that you will not use our website for any purpose that is illegal or prohibited by these terms and conditions, including without limitation the posting or transmitting of any libellous, defamatory, inflammatory or obscene material. If you breach these terms and conditions then your permission to use this website terminates immediately without the necessity of any notice being given to you. We retain the right to deny access to any person who fails to comply with these terms and conditions.

    8 Our Technical and Customer Support

    We provide technical and customer support in relation to the operational aspects of the SIM card for a period of six months from the date you purchased the Products. Upon expiry of the six months it will be your sole responsibility to resolve all operational issues directly with the appropriate mobile phone network.

    9 Security

    You are solely responsible in all respects for all use of and for protecting the confidentiality of any username, e-mail verification and password that may be given to you or selected by you for use on our website. You may not share these with or transfer then to any third parties. You must notify us immediately of any unauthorised use of them or breach of security regarding our website that comes to your attention.

    10 Applicability of online materials

    10.1 Unless otherwise specified all content and materials published on our website are presented solely for your private, personal and non-commercial use.

    10.2 You assume total responsibility and risk for your use of our website and use of all information contained within it.

    10.3 We have used our best endeavours to ensure that our website complies with UK laws. However, we make no representations that materials on our website are appropriate or available for use in locations outside the UK. Those who visit our website from other locations do so on their own initiative and are responsible for compliance with all applicable laws. If use of our website and/or viewing of it, or use of any material or content on our website or services, or products offered through our website or services, are contrary to or infringe any applicable law in your jurisdiction(s), you are not authorised to view or use our website and you must exit immediately.

    11. Copyright and monitoring

    The contents of our website are protected by international copyright laws and other intellectual property rights. We or other third party licensors are the owner of these rights. All product and company names and logos mentioned in our website are trade marks, service marks or trading names of their respective owners, including us. You may download material from our website for the sole purpose of placing an order with us or using our website as a shopping resource. However, you may not modify, copy, reproduce, republish, upload, post, transmit or distribute, by any means or in any manner, any material or information on or downloaded from our website including but not limited to text, graphics, video, messages, codes and/or software without our prior written consent, except where expressly invited to do so, for example in order to complete any test or questionnaire.

    We make no representations whatsoever about any other websites which you may access through our website or which may link to our website. When you access any other website you understand that it is independent from us and that we have no control over the content or availability of that website. In addition, a link to any other website does not mean that we endorse or accept any responsibility for the content, or the use of, such a website and we shall not be liable for any loss or damage cause or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any other website or resource. Any concerns regarding any external link should be directed to its website administrator or web master.

    13. Availability of our website

    We will try to make our website available but cannot guarantee that our website will operate continuously without interruptions or be error free and can accept no liability for its unavailability. You must not attempt to interfere with the proper working of our website and, in particular, you must not attempt to circumvent security, tamper with or hack into, or otherwise disrupt any computer system, server, website, router or any other internet connected device.

    14. Our liability and your liability

    14.1 We promise that for any Products you purchase from our website:

    • We have the right to sell the Products to you;

    • The Products will be of satisfactory quality and;

    • The products are fit for use in the destination country and not necessarily in the UK (excluding the UK and global SIMs)

    • Will be fit for any other purpose for which you have bought it and you notified us of this purpose before purchase, and we have not informed you that the Products are not fit for that purpose;

    14.2 Subject to this, however, the Products are not sold as being fit for any particular application or for use under specific conditions, unless expressly agreed in writing. We also promise that any service we provide to you will be provided with reasonable skill and care.

    14.3 We exclude all other express or implied terms, conditions, warranties representations or endorsements whatsoever with regard to any products (including without limitation the Products), our website or any information or service provided through our website.

    14.4 We will do our best to ensure that all materials and information including Products specification published on our website are accurate, but please note that all content, materials and information on our website are provided on an ‘as is’ basis and you assume total responsibility and risk for your use of our website and use of all information contained within it.

    14.5 In order to provide the Service we are reliant upon the performance of independent third party organisations including network service providers. We cannot and do not guarantee the continued provision of network services in any territory by a network service provider. There may be failures or decisions taken on the part of the network service provider over which we have no control and for which we cannot assume any liability including not limited to the insolvency of the appropriate network service provider. In such circumstances we will not be liable to refund any SIM purchase costs or charges to you and it will be your responsibility to contact the appropriate network service provider directly in relation to any compensation or credits you consider are remaining on your account at the point at which the network services were terminated.

    14.6 We cannot in any way guarantee network coverage as this is wholly beyond our control. If you wish to review general information about network coverage please see the section on this website which details the same. For the avoidance of doubt we will not be liable to you for any refund of charges in the event you experience poor coverage.

    14.7 We will not be responsible for unlocking of any handset and no refund will be provided to you in the event the handset cannot be unlocked for whatever reason. It is your responsibility to satisfy yourself you have unlocked the handset. However we do provide helpful advice by way of guidance only on unlocking handsets on this website. You must ensure that the handset is unlocked prior to using the Products or SIM card we provide to you.

    14.8 We are not responsible for any mobile phone network promotions, free starter credit provided by any network or other promotional offers made available by a network.

    14.9 We accept no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect) in each case, however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of our website or its contents other than as a direct result of purchasing Products which shall be subject to the exclusions and limitation of liability set out in these terms and conditions, we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on our part or our servants, agents or any other person or entity.

    14.10 If we are liable to you for any reason, our liability will be limited to the amount paid by you for the Products concerned. This limit does not apply to any liability we may have for death or personal injury resulting from our negligence or for our fraudulent misrepresentation.

    14.11 You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use our website and is compatible with our website. You also understand that we cannot and do not guarantee or warrant that any material available for downloading from our website will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.

    14.12 The limitations and exclusions in this clause do not affect your non-excludable statutory rights and only apply to the extent permitted by applicable law.

    15 SIM Cards and the actions of mobile phone networks

    15.1 It is important to note that local mobile telecommunications networks;

    15.1.1 reserve the right to alter the tariff rate at any time. Rates and tariffs are set by the network and discrepancies or changes must be addressed directly to the network in question. Although we constantly monitor such tariffs occasionally errors occur;
    15.1.2 reserve the right to modify the amount of airtime included with each SIM Card. Such alterations may reduce or increase the amount of initial calling credit.
    15.1.3 reserve the right to change, add or delete any of the services provided through the SIM card.

    15.2 We will not be liable for your incorrect use of a SIM card. Incorrect use may include ( but not be limited to );

    15.2.1 using an activated or registered foreign SIM in the UK before arrival in the destination.
    15.2.2 the incorrect insertion of PIN and PUK codes which result in the SIM card becoming blocked.
    Notwithstanding the limitations in this clause 15.2 we do however provide comprehensive instructions to avoid the likelihood of such errors and also provide a customer support service when problems of this kind do arise.

    16 SIM Card GSM Operator Tariffs

    We provide pre-paid SIM cards for national and specialist GSM networks. The call rate and tariff for each card is under the sole control of each GSM network. We will use our best endeavours to update our website with revised details of such charges as related to us by the appropriate network but will not be liable for any change to network tariffs or charges. Any queries relating to such alterations must be directed to the appropriate network.

    17 Access Numbers

    17.1 Callers using the 0044 dialthrough service must ensure that they have the consent of the bill payer before using the service and use a BT land line service. All calls are billed (**) telephone line provider at their relevant 0870, 0871, 0844. 0845, and relevant 0905 rates.

    17.2 Calls are charged from the time of connection to the 0044 dialthrough service. We therefore advise replacing the handset after a short period if your calls are engaged or unanswered.

    18. General

    18.1 We may assign, transfer, novate or subcontract any or all of our rights and obligations under these terms and conditions at any time.

    18.2 We may alter these terms and conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the terms and conditions on the website regularly.

    18.3 These terms and conditions together with the privacy policy, any order form and payment method instructions, if any, are the whole agreement between us. You acknowledge that you have not entered into this agreement in reliance upon any statement, warranty or representation made by us or any other person and you irrevocably and unconditionally waive any rights to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) that is not contained in the terms and conditions, privacy policy, order for and payment method instructions.

    18.4 If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.

    18.5 These terms and conditions and your use of our website are governed by English law and you submit to the non-exclusive jurisdiction of the English court.

    18.6 Except in respect of a payment obligation, neither you nor us will be held liable for any failure to perform any obligation to the other due to causes beyond your or our respective reasonable control.

    18.7 Failure or delay by either party enforcing an obligation or exercising a right under these terms and conditions does not constitute a waiver of that obligation or right.

    18.8 We are entered on the following trade or similar registers (tbc)

    18.9 These terms and conditions do not confer any rights on any person or party (other than you and/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999.

    19. Notices

    19.1 All notices shall be given:

    • to us via e-mail at info@0044.co.uk or by post at 0044 Limited, 2 Chapel Court, Holly Walk, Leamington Spa, Warwickshire CV32 4YS ; or

    • to you at either the e-mail or postal address you provide during the ordering process.

    19.2 Notice will be deemed received when an e-mail is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the date of posting.

    20. Replacement

    These terms and conditions replace all other terms and conditions previously applicable to the use of our website and/or sale of the Products.
